Shipping Policy

This Shipping Policy applies to all orders and deliveries of products ("Products") by Kuzco Art Maison ("Kuzco") to its business customers ("Customer"). By placing an order with Kuzco, the Customer agrees to this Shipping Policy.

 

1. Delivery

1.1 Delivery Times
All delivery dates communicated or acknowledged by Kuzco are approximate and non-binding. While Kuzco endeavours to deliver Products within the agreed timeframe or on the specified date, such dates are merely estimates. Failure to deliver the Products within the delivery period or on the specified date, regardless of the reason, does not entitle the Customer to any compensation or termination of the agreement.

1.2 Delays and Force Majeure
Kuzco is not liable for any delays, loss, or damage during transport. Kuzco may delay any delivery in the event of production issues that affect the quantity or quality of the Products. If such a delay lasts longer than three (3) calendar months, either party has the right to cancel the order in writing without liability. In the event of cancellation, Kuzco is not liable for any losses, including but not limited to special, consequential, or indirect damages, such as loss of profit or missed savings.

1.3 Failure to Accept Delivery
If the Customer fails to take delivery of the Products at the agreed time and place or fails to provide the necessary information or instructions to enable the delivery, the Customer is fully liable to Kuzco for all damages and losses incurred by Kuzco as a result. This includes, but is not limited to, additional transport costs, storage costs, handling charges, and insurance costs. For redelivery, Kuzco may require prior payment of all such costs.

 

2. Delivery Conditions

2.1 Partial Deliveries
Kuzco reserves the right to allocate available Product stock at its sole discretion among its existing or potential customers without incurring liability for the allocation method or its implementation. Kuzco may, at its discretion and without liability or penalty, make partial deliveries of Products to the Customer. Each delivery is considered a separate transaction. The Customer is obliged to pay for the delivered Products, regardless of whether such delivery fully or partially satisfies the Customer’s original order.

2.2 Product Modifications
The Customer acknowledges that minor changes in shape, colour, and/or construction of the Products may occur due to the materials used, the design, or other reasons. The models, illustrations, drawings, and dimensions presented by Kuzco provide a general representation of the Products. Modifications that result in the actual design differing to some extent from the models, illustrations, drawings, or dimensions, but do not cause a material change to the technical or aesthetic design, do not entitle the Customer to reject the delivered Products or withhold payment. Such modifications are not considered a default by Kuzco.

 

3. Inspection and Complaints

3.1 Inspection on Delivery
Upon receipt of the Products, the Customer must inspect the condition of the packaging. If the packaging shows visible defects or damage, the Customer must open the packaging in the presence of the carrier and inspect the Products for damage.

3.2 Defect Notification
If, in the reasonable opinion of the Customer, the delivered Products are not in accordance with the ordered Products, are deficient in quantity, or exhibit defects without fault of the Customer, the Customer must notify Kuzco in writing via email to info@kuzcoartmaison.com without delay, but no later than fourteen (14) calendar days after the delivery date. Notifications received after this period will not be considered. The complaint must be as detailed as possible and accompanied by digital photographic evidence supporting the claim.

3.3 Separate Transactions
Each delivery is considered a separate transaction. Complaints regarding a specific delivery do not affect previous or future deliveries and do not entitle the Customer to suspend or offset their obligations in relation to other deliveries.

 

4. Returns and Replacements

4.1 Returning Products
Defective or non-compliant Products, as determined by Kuzco in its reasonable discretion in accordance with clause 3.2, may only be returned with Kuzco’s prior written approval or at Kuzco’s express request. Returns without such approval will not be accepted. The return costs are borne by Kuzco, provided this has been agreed upon in advance.

4.2 Return Period
If Kuzco authorises a return, the Products must be received by Kuzco within fifteen (15) business days. If the Products are not received within this period, the Customer will be deemed to have withdrawn their complaint, and Kuzco will not be obliged to issue any refund, credit, or replacement.

4.3 Replacement and Costs
In the event of a replacement of defective or returned Products, the Customer is responsible for all additional costs, including but not limited to assembly, disassembly, reinstallation, adjustment of technical installations, and other related expenses.

 

5. Documentation and Recalls

5.1 Sales Record
The Customer is obliged to accurately document all sales deliveries. The Customer must retain distribution and sales records for at least seven (7) years. Upon Kuzco’s first request, these records must be provided, particularly if a recall of Product(s) is deemed necessary.

5.2 Recalls
Kuzco has the right to require the Customer to remove from the market any Products that are defective or could reasonably be considered defective, within a reasonable period specified by Kuzco. All costs and expenses associated with and arising from such a recall are borne by the Customer.

 

6. Liability

6.1 Limitation of Liability
Kuzco is not liable for any damage, loss, or costs incurred during the transport of the Products. The risk of loss or damage to the Products passes to the Customer upon delivery.

6.2 Force Majeure
In the event of force majeure, including but not limited to production issues, natural disasters, strikes, or other unforeseen circumstances beyond Kuzco’s control, Kuzco cannot be held liable for any delay or failure to deliver the Products.

Final Provision

This Shipping Policy forms an integral part of the Terms and Conditions of Kuzco Art Maison. In the event of any inconsistencies between this Shipping Policy and the Terms and Conditions, the provisions of the Terms and Conditions shall prevail.

This Shipping Policy has been drafted in Dutch. While it may be translated into other languages for convenience or other purposes, in the event of any interpretation or clarification—whether due to a disagreement between the parties or otherwise—the Dutch version shall prevail over any translated version.
